Air Canada faces renewed scrutiny after a family endured a 33-day ordeal in Panama. The incident, which happened in 2017, involved a Venezuelan mother and her three children traveling to visit the children’s father in Toronto. They held valid visas and proper travel documents. However, Air Canada staff stopped them at the Panama airport and flagged their visas without contacting immigration officials.
As a result, the airline triggered an unexpected visa cancellation. Consequently, the family had no legal way to continue their trip. They remained stuck in Panama for more than a month while facing emotional and financial stress. Moreover, Air Canada made this decision without a formal “no board” directive from Canadian authorities. The court confirmed the airline acted on unverified concerns, not official instructions.
Eventually, after a legal review, officials restored the family’s visas. Authorities recognized their connection to a lawful Canadian resident. Under proper procedures, immigration would have confirmed their right to travel. However, Air Canada’s interference blocked this step and caused significant harm. Therefore, the court ruled that the airline overstepped its legal role in the process.
Additionally, the court ordered Air Canada to pay US$3,100 (CA$4,100) in compensation to the family. This amount aimed to address the hardship and damages they suffered. The ruling emphasized that only immigration officers can assess visa legitimacy. Airlines, including Air Canada, should only verify travel documents, not interpret immigration laws.
In response, Air Canada raised concerns about how the decision may affect airline compliance procedures. Although airlines often face fines for boarding passengers with invalid documents, this case warns against taking action without clear authority. As a result, aviation experts expect airlines to enhance training and tighten policy reviews.
Today, the family has settled in Canada. Yet, their story continues to spark debate. The judgment sends a strong message to all airlines about respecting legal limits during document checks.
